Buyer Policy
This Buyer Policy outlines the terms and conditions that govern your purchases through our marketplace. By making a purchase on our marketplace, you acknowledge that you have read, understood, and agree to be bound by this Buyer Policy, in addition to our Terms of Service and other policies.
1. Ordering and Transactions
- Product and Service Listings: We strive to ensure that product and service listings are accurate and complete. However, Hemp Save The World is a marketplace that hosts independent Sellers. We do not guarantee the accuracy, completeness, or reliability of any product or service descriptions, images, pricing, or other content provided by Sellers. It is your responsibility to carefully review all product or service information before making a purchase.
- Placing Orders: When you place an order, you are offering to purchase the product(s) or service(s) from the Seller. The Seller has the right to accept or decline your order.
- Order Confirmation: Upon placing an order, you will receive an order confirmation email. This email confirms that your order has been received by the Seller, but it does not guarantee acceptance of your order.
- Payment: You are responsible for paying the total amount for your order, including the product price, applicable taxes, and shipping fees. We utilize secure payment processing methods. By providing your payment information, you represent and warrant that you are authorized to use the payment method.
- Shipping and Delivery: Shipping and delivery timelines are determined by the Seller. Hemp Save The World is not responsible for shipping delays or issues once the order has been shipped by the Seller. Please refer to the Seller’s individual shipping policies, which may be available on their Store or product or service page.
- Taxes: You are responsible for paying any applicable sales taxes or other taxes associated with your purchase.
2. Product Information and Disclaimer
- Hemp Product and Service Information: You understand that the products and services offered on our marketplace are hemp-based. You are responsible for ensuring that you are aware of and comply with all applicable local, regional, and national laws and regulations regarding the purchase, possession, and use of hemp-based products in your jurisdiction.
- No Medical Claims: Sellers are prohibited from making medical claims about their products or services. Information provided on our marketplace is for informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider for any health concerns or before making any decisions related to your health or treatment.
- Third-Party Content: Our Site may contain links to third-party websites or resources. Hemp Save The World is not responsible for the content, accuracy, or practices of these third-party websites.
3. Returns, Refunds, and Cancellations
- Seller’s Terms and Conditions: Each Seller on our marketplace is responsible for establishing their own Terms and Conditions, which include details about their policies on: returns, exchanges, refunds, warranties, cancellations, shipping, privacy and more. A Seller’s Terms and Conditions should be clearly displayed on the Seller’s Store or product or service page.
- Reviewing Seller’s Terms and Conditions: It is your responsibility to carefully review a Seller’s Terms and Conditions before purchasing a Seller’s product or service.
- Initiating Returns or Refunds: If you wish to request a return or refund, you must contact the Seller directly through the marketplace messaging system. Hemp Save The World is not directly involved in the return or refund process between Buyers and Sellers unless explicitly stated in this policy.
- Hemp Save The World’s Role: While we encourage Sellers to have fair and reasonable return policies, Hemp Save The World is not obligated to provide refunds or accept returns on behalf of Sellers unless the issue falls under the specific circumstances outlined in Section 4 (Dispute Resolution).
- Cancellations: Cancellation policies vary by Seller. Some Sellers may allow order cancellations within a specific timeframe after purchase, while others may not. Please refer to the Seller’s Terms and Conditions.
4. Dispute Resolution
- Direct Communication with Seller: If you have any issues or concerns regarding your purchase (e.g., product defects, incorrect items, non-delivery, non-performance), you are encouraged to first contact the Seller directly through the marketplace messaging system to attempt to resolve the issue amicably.
- Hemp Save The World Assistance: If you are unable to resolve the issue directly with the Seller after a reasonable period (typically 7 days), you may contact Hemp Save The World’s customer support team at support@hempsavetheworld.com.
- Dispute Review Process: When you contact us for assistance, we will review the communication between you and the Seller, the Seller’s policies, and any relevant information to help facilitate a resolution.
- Limited Intervention: Hemp Save The World’s role in dispute resolution is limited. We will make reasonable efforts to mediate disputes in good faith, but we do not guarantee a resolution in your favour.
- Grounds for Hemp Save The World Intervention: Hemp Save The World may intervene in disputes in the following limited circumstances:
- Seller’s Breach of Policy: If the Seller has demonstrably violated our Terms of Service or our policies.
- Fraudulent Activity: If there is evidence of fraudulent activity by the Seller.
- Failure to Ship (after a reasonable period): If the Seller has failed to ship the product within a reasonable timeframe as stated in their shipping policy or as communicated to you.
- Evidence Required: When submitting a dispute, you may be required to provide supporting documentation, such as photos, screenshots of communication, and order details.
- Final Decision: Hemp Save The World reserves the right to make the final decision on dispute resolutions in the limited circumstances where we intervene. This decision will be binding.
- Chargebacks: We encourage you to resolve disputes directly with the Seller or through our dispute resolution process before initiating a chargeback with your payment provider. Chargebacks can be time-consuming and may impact your ability to use the marketplace in the future. We reserve the right to ban any User found to have repeated or fraudulent chargebacks.
5. Buyer Conduct
- Respectful Communication: In accordance with our Community Policy, you agree to communicate respectfully and professionally with Sellers and Hemp Save The World’s customer support team.
- Honest Feedback: You are encouraged to leave honest and constructive feedback and reviews about your purchases from Sellers and experience with our Services.
- Compliance with Laws: You agree to comply with all applicable laws and regulations when using the marketplace and purchasing products or services.
- Prohibited Activities: You agree to abide by our Community Policy and not to engage in any of the following activities:
- Making false or misleading claims,
- Attempting to manipulate the feedback or review system,
- Engaging in any fraudulent or illegal activity,
- Harassing or threatening Sellers or other Users,
- Violating any of our Terms of Service or other policies.
6. Feedback and Reviews
- Importance of Feedback: We encourage Buyers to leave feedback and reviews after completing a purchase. This helps other Buyers make informed decisions and allows Sellers to improve their offerings.
- Responsibility for Content: You are solely responsible for the content of your feedback and reviews. They must be accurate, truthful, and respectful.
- Removal of Feedback: We reserve the right to remove feedback or reviews that violate our policies, are deemed inappropriate, or are suspected to be fraudulent.
7. Wholesale Buyers
A Buyer may apply to become a Wholesale Buyer. Hemp Save The World reserves the right to revoke wholesale privileges at any time if account activity or representation fails to comply with our Wholesale Policy. Please see our Wholesale Policy for more information about becoming a Wholesale Buyer.
8. Limitation of Liability
- Marketplace Platform: You acknowledge that our marketplace platform facilitates transactions between Buyers and Sellers. We are not the Seller of the products or services offered on the marketplace.
- Disclaimer of Warranties: To the fullest extent permitted by applicable law, Hemp Save The World disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Limitation of Liability: To the fullest extent permitted by applicable law, Hemp Save The World shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services or your purchases from Sellers, even if we have been advised of the possibility of such damages. Our total liability to you for all claims arising out of or relating to this Buyer Policy or your use of our Services shall not exceed the total amount you paid for the specific product or service that is the subject of the claim.
9. Indemnification
You agree to indemnify and hold harmless Hemp Save The World, its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or relating to your use of our Services, your purchases, your violation of this Buyer Policy, or your infringement of any intellectual property or other rights of any third party.
10. Governing Law and Jurisdiction
This Buyer Policy shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the Provincial and Supreme Courts located in the City of Kelowna, British Columbia, Canada for the resolution of any disputes arising out of or relating to this Buyer Policy or our Terms of Service.
11. Changes to this Policy
Hemp Save The World reserves the right to modify or update this Buyer Policy at any time without prior notice. Any changes will be effective immediately upon posting the revised Buyer Policy on our Site. Your continued use of our Services after the posting of any changes constitutes your acceptance of such changes. We encourage you to review this Buyer Policy periodically for updates.
