Seller Policy

This Seller Policy outlines the terms and conditions that govern your activities as a Seller on our Services. By listing and selling products or services on our marketplace, you acknowledge that you have read, understood, and agree to be bound by this Seller Policy, our Terms of Service and our other policies.

1. General Rules

Sellers agree to list and sell their products or services through the Hemp Save The World marketplace, and to not use our platform as a lead generation or marketing tool to direct Users elsewhere like their own website or other selling platform. Users may not use our website, community, or social media accounts to entice our Sellers to join another selling platform or their own marketplace. Sellers may add their social network links to build your following in your Store settings.

2. Eligibility

Any business that offers industrial hemp-based items or services may become a Seller on Hemp Save The World, so long as they have an up-to-date business license and follow all applicable local, regional, and federal laws and regulations. By applying to become a Seller on our marketplace, you agree to this Seller Policy, our Terms of Service, our Community Policy, and all our other policies.

As identified under Prohibited Items and Services below, we prohibit the offering, sale, or provision of items or services related to marijuana, THC products, CBD products, smokables, cannabis flowers, and paraphernalia. We recognize the legality of CBD products, and will continue to work with our payment service provider to allow them in the future.

3. Seller Conduct and Responsibilities

  • Account Responsibility: You are responsible for maintaining the security of your Seller account and for all activities that occur under your account. You must notify us immediately of any unauthorized access to your account.
  • Insurance Requirements: You are responsible for acquiring and maintaining insurance for your business operations as it relates to our platform. See more information listed in Section 4. 
  • Compliance with Laws: You are solely responsible for ensuring that your products, services, listings, and business practices comply with all applicable local, regional, and federal laws and regulations.
  • Accuracy of Information: You are responsible for the accuracy and completeness of all information you provide in your Seller application, profile, Store, product or service listings, and communications with other Users.
  • Seller’s Terms and Conditions: You are responsible for uploading and maintaining your own Terms and Conditions to your Store which should include, but is not limited to, details about: returns, exchanges, refunds, warranties, cancellations, shipping, privacy and any other terms you may have.
  • Professionalism: You agree to conduct your business and interact with other Users on our Services with professionalism and integrity.
  • Compliance with our Policies: You agree to comply with all of our policies, including this Seller Policy, our Terms of Service, and our other policies.
  • Prohibited Activities: You are prohibited from engaging in any of the following activities:
    • Uploading any prohibited items, services, or other content.
    • Listing externally linked or affiliate products.
    • Manipulating prices or fees.
    • Engaging in false advertising or making misleading claims.
    • Unauthorized third-party reselling.
    • Attempting to circumvent our Services to complete transactions with other Users on another website or platform.
    • Discriminating against Buyers based on any protected characteristic.
    • Harassing or abusing Buyers or other Sellers.
    • Violating any applicable laws or regulations.
  • Feedback and Reviews: Buyers may leave feedback and reviews about their purchases from you. You are encouraged to maintain a high level of customer service to receive positive feedback. Hemp Save The World reserves the right to remove feedback that violates our policies.
  • User Data Privacy: You are responsible for protecting the privacy of any User data you access through our Services and using it only for the purpose of fulfilling orders and providing customer service, in accordance with our Privacy Policy and applicable data protection laws. You may not collect any of our User’s data, or add any of their data to any mailing list, without their expressed consent.
  • Contacting Buyers: You may only contact Buyers if they have explicitly contacted you in regard to your Store, Seller Offerings, or an order they have placed with your Store. You may not contact Buyers for any other purpose.

4. Seller Insurance Requirements

To guarantee a safe and trustworthy environment for all users of Hemp Save The World, and to protect both Sellers and Buyers, all Sellers on our platform are required to maintain specific insurance coverages. These requirements are non-negotiable and must be met and maintained for the duration of your active selling status on Hemp Save The World.

Commercial General Liability Insurance (Required)

To ensure comprehensive coverage for all operations on our marketplace, Sellers are required to obtain and maintain their own Commercial General Liability insurance policy. This policy must be in place within 30 days of your gross sales reaching CAD $10,000 in a single month, or immediately upon our request, whichever comes first.

This essential coverage protects against claims of bodily injury or property damage to third parties arising from your business operations, including incidents that may occur at your business premises (if applicable) or through your online activities. It also protects you against claims of injury, illness, or property damage allegedly caused by a product you sell, including those due to manufacturing defects, design flaws, or inadequate warnings/instructions, even if you are not the manufacturer.

Your insurance policy must meet the following criteria to ensure adequate coverage for all parties involved:

  • Policy Type: Your policy must be an occurrence-based commercial general, umbrella, or excess liability policy.
  • Coverage Limit: Your policy must have a minimum limit of CAD $1,000,000 per occurrence and in aggregate
  • Integral Components: Your policy coverage needs to extend to liabilities arising from your business operations, thus Product Liability, and/or Completed Operations Liability must be integral in your policy depending on your Seller Offerings on our marketplace.
  • Deductible: Any deductible on your policy cannot exceed CAD $10,000. The exact deductible amount must be clearly stated on your Certificate of Insurance.
  • Scope of Coverage: Your policy must specifically cover all sales of products or services you list on our marketplace.
  • Additional Insured: Your policy must explicitly name “Hemp Save The World Merchandising and its affiliates and assignees” as additional insureds on your Commercial General Liability policy.
  • Insured Name Match: Unless you are a single-member LLC, the insured name on your policy must precisely match the legal entity name you provided in your account information. For single-member LLCs, if your legal entity name differs from your publicly used trade name (or “doing business as” name), it is acceptable for your insured name to match your trade name.
  • Insurance Provider Rating: Your insurance provider must possess global claim handling capabilities and hold a financial rating of S&P A- and/or AM Best A- or better. If S&P or AM Best ratings are not applicable in the country where you obtain insurance, a local equivalent rating is acceptable.
  • Policy Completion: Your insurance policy must be fully completed and signed.
  • Notice of Change: Your insurance provider must commit to providing our company with at least 30 days’ advance notice in the event of policy cancellation, modification, or non-renewal.

We understand that securing insurance can sometimes be challenging. We will consider exceptions to these requirements on a case-by-case basis if you are genuinely unable to obtain a policy that meets all these criteria.

Certificate of Insurance (Required)

Upon registration and annually thereafter, Sellers are required to submit a current Certificate of Insurance directly from their insurance provider(s) to Hemp Save The World. It must clearly indicate:

  • The name of the Insured (your business name).
  • The policy number(s).
  • The effective and expiry dates of the policy (coverage must be active for the entire period you are selling on our platform).
  • The types of coverage and their respective limits, meeting our minimum requirements.
  • That “Hemp Save The World Merchandising and its affiliates and assignees” is listed as additional insureds on the Commercial General Liability policy.

Cyber Liability Insurance (Recommended)

In today’s digital landscape, where cyber threats are constantly evolving, it is paramount for our Sellers to acquire their own comprehensive Cyber Liability insurance

While our platform implements robust security measures and may handle certain aspects of data protection, your business, as an independent entity, maintains direct exposure to various cyber risks. This includes the potential for data breaches involving customer information you manage, disruptions to your operations from ransomware or other attacks, and legal or regulatory penalties stemming from incidents impacting your systems. 

A dedicated cyber liability policy will provide crucial financial protection, covering costs such as lost income due to business interruption, forensic investigations, data recovery, legal defense, customer notification, credit monitoring services, public relations, regulatory fines, and legal fees arising from lawsuits related to a breach of customer data handled by your business.

By proactively securing this coverage, you not only safeguard your own business’s financial well-being and reputation but also contribute to the overall security and trustworthiness of our marketplace.

Ongoing Compliance

It is the Seller’s sole responsibility to ensure that their insurance policies remain active and compliant with these requirements at all times. Any lapse in coverage or failure to meet the minimum requirements may result in the suspension or termination of your selling privileges on Hemp Save The World.

Sellers must promptly notify Hemp Save The World of any changes to their insurance policies or any claims that may impact their coverage relevant to their activities on our platform.

Seller Responsibility and Independent Advice

The insurance requirements outlined above are minimum standards set by Hemp Save The World. Sellers are solely responsible for assessing their own business risks and determining if additional or higher levels of insurance coverage are necessary for their specific products, services, and operations.

We strongly advise all Sellers to consult with a qualified and licensed insurance broker to obtain appropriate coverage tailored to their business needs. Hemp Save The World does not provide insurance advice, and this policy section is not a substitute for professional insurance consultation.

Restricted Products and Services

Please be reminded that Sellers are strictly prohibited from offering any prohibited products or services on Hemp Save The World as outlined in Section 7 – ‘Seller Offerings.’ Your insurance policies must reflect your business operations, which must comply with our platform’s permissible product and service guidelines.

5. Subscription Plans and Fees

We offer multiple subscription plans to fit your business’ needs, whether you’re a budding entrepreneur or a well established business. We reserve the right to change our fees at any time, but will provide you with reasonable notice of any changes to our fees. Please see the following sections for details about our subscription plans and fees.

Subscription Fee

Subscriptions automatically renew and subscription fees will be charged every month. The fees listed are in Canadian unless otherwise noted. Where applicable, we will charge sales tax on your monthly subscription fee. You can upgrade, downgrade, or cancel your subscription anytime within the ‘Subscription’ section of the Seller dashboard. Commission Fee

When you make a sale through our platform, you will be charged a commission fee. The commission fee is a combined percentage and flat rate, based on your current subscription plan, of the price you display for your listings (Seller Offerings) paid to us for our services.

Transaction Fees

We will facilitate payment processing between Buyers and Sellers. Every transaction must be completed through our chosen payment processor, Stripe. See Stripe’s list of supported countries. You agree to abide by Stripe’s Services Agreement. Payment processing fees vary based on the location of your bank account. The payment processing fee is assessed on the total amount of the sale, including tax and postage, and is deducted from the sale amount.

[IF MULTIPLE PAYMENT PROCESSORS] We will facilitate payment processing between Buyers and Sellers. You agree to abide by the terms of our chosen payment processors. Every transaction must be completed through a payment gateway provider, each of which charges a different payment processing fee. Payment processing fees also vary based on the location of your bank account. The payment processing fee is assessed on the total amount of the sale, including tax and postage, and is deducted from the sale amount.

Number of Listings

You may upload a maximum number of listings (Seller Offerings) depending on your current subscription plan, and may switch between subscription plans at any time to match the needs of your business. However, if you decide to downgrade your subscription and currently have more listings than are allowed for the new subscription plan, any listings in excess of the new subscription’s limit will be set to ‘draft’ status and you’ll need to prioritize which listings you want to list in your Store.

Featured Listings

At any time, for a fee, you may feature (advertise) one of your listings for seven (7) days. Featured listings appear at the top of your store page as well as featured sections throughout our site. Sellers may feature listings via their Products section in their Sellers Dashboard. Each subscription plan above Seed level includes a set number of free featured listings.

Verification Badge

Upon successful completion of our verification process, Sellers will be awarded the Hemp Save The World Verified Badge. This badge is a proprietary trust mark for all to see. Learn more about the Verification Badge in section 6.

Seller Story Program

For Sellers on qualifying subscription tiers and wish to participate, Hemp Save The World provides custom editorial services to produce a “Seller Story.” This content is a professional feature designed to highlight the Seller’s history, mission, and industrial innovation. While the participating Seller provides the foundational facts and imagery, the final “Seller Story” is an original work of authorship created by Hemp Save The World.

Licensing & Usage

By participating in the Seller Story Program, the Seller grants Hemp Save The World a non-exclusive, worldwide, royalty-free license to use the Seller’s name, logo, and provided media for the purpose of creating and promoting this feature.

Tier-Based Accessibility & Removal

The “Seller Story” is a premium platform benefit tied to specific subscription levels. Access to this feature is subject to the following conditions:

  • Downgrade of Service: If a Seller elects to downgrade to a subscription tier that does not include the Seller Story benefit, Hemp Save The World reserves the right to archive, unpublish, or permanently remove the Seller Story from our platform, including but not limited to homepage spotlights and category features.
  • Termination of Account: Should a Seller decide to close their Store or account, or if the Seller’s account is suspended or terminated by Hemp Save The World, the Seller Story will be removed from the active site directory.

Upon removal due to a downgrade, suspension, or termination, Hemp Save The World is under no obligation to provide the raw editorial files to the Seller, as the final article remains the intellectual property of the platform.

Content Integrity

Hemp Save The World reserves the right to edit or update Seller Stories to ensure they remain aligned with our focus and our current site formatting standards.

Featured Seller

Verified Sellers with a current Grow or Bloom subscription are eligible for “Featured Seller” on Hemp Save The World – highlighting the Featured Sellers in our marketplace, increasing their visibility and building trust. A “Featured” label is applied to the Seller, which enables specific placement throughout our marketplace in featured sections and lists, including the Store List.

Homepage Feature

Verified Sellers with a current Bloom subscription are eligible for “Homepage Feature” on Hemp Save The World. This includes a high-visibility logo placement on our homepage; linking directly to your Store.

Editorial Discretion & Scheduling

Hemp Save The World maintains absolute editorial discretion over the arrangement, duration, and visual styling of homepage features. While we aim to provide maximum exposure for our premium Sellers, specific placement locations are subject to the platform’s marketing calendar and seasonal rotations.

Removal and Reversion Rights

Homepage Featured placement is a premium benefit directly tied to active, high-tier membership. Hemp Save The World reserves the right to immediately remove a Seller’s feature from the homepage under the following circumstances:

  • Tier Downgrade: If a Seller moves to a subscription tier that does not include Homepage Featured benefits, their brand assets will be removed from the homepage at the end of the current billing cycle.
  • Account Inactivity or Departure: Should a Seller decide to close their Store or account, or if the Seller’s account is suspended or terminated by Hemp Save The World, the Seller’s Homepage Feature will be vacated immediately to ensure a seamless experience for active buyers.
  • Inventory Thresholds: To protect the user experience, Hemp Save The World reserves the right to temporarily pull a Seller’s Homepage Feature if their products are out of stock or if the Seller fails to maintain active shipping status.
Non-Transferability

Homepage Feature slots are assigned to specific verified Sellers and cannot be traded, sold, or transferred to third-party entities or unauthorized sub-brands.

Changing Subscriptions

If you wish to change your subscription, your features and fees will be adjusted to your new subscription tier. Please follow the steps below to change your subscription:

  • Cancel your current subscription. This is to ensure your current subscription is canceled with our payment processor.
  • Purchase your new desired subscription. This will create a new subscription with our payment processor.
  • Republish your listings. During this process, your listings’ status will have been changed to ‘Draft’ because your new subscription allows for a different number of listings. Note, downgrading will limit how many listings you can republish. To republish your listings:
      1. Go to “Products”
      2. Select the listings you wish to republish
      3. Click “Bulk Actions”
      4. Select “Publish Products”
      5. Click “Apply”

Cancelations

If you wish to cancel your subscription, you will have access to your Seller account until the end of that subscription period.

After your subscription has ended, your Store will be suspended and all of your Seller Offerings will be set to ‘draft’ status. You will still be responsible for fulfilling any outstanding orders and addressing any issues from Buyers. We may withhold payouts for a reasonable period to ensure completion of transactions and resolution of disputes.

Fee Avoidance

Fee avoidance is strictly prohibited, and is considered to be any action a Seller makes to avoid paying a fee.

A transaction initiated on our platform may not be completed off of our platform. As set out in our Terms of Service and this Seller Policy, you agree not to encourage Users to participate in transactions outside of our Services in an attempt to avoid paying our fees, and acknowledge such behaviour may lead to the suspension or termination of your account.

We reserve the right to deduct any fees, chargebacks, refunds, or other amounts owed from your payouts. Your Store may be suspended at any time until your outstanding balance is paid in full. To avoid Store suspension, please pay any outstanding balances owed.

We reserve the right to change our fees at any time. We will provide you with reasonable notice of any changes to our fees.

6. Application and Verification Process

How to Sell With Us

All hemp-based products and services, except those prohibited, are welcome on the Hemp Save The World marketplace. Follow the steps below to apply to register as a Seller on our marketplace:

  1. Learn more on our Sell With Us page
  2. In the Subscription section, click on the ‘Sign-up’ button below the subscription plan you wish to purchase, this will take you to the registration page
  3. Complete the form, including all required information
  4. Confirm you have read and agree to our Terms of Service
  5. Choose a subscription pack by clicking on the dropdown menu
  6. Click ‘Register’

The address you provide when registering your Seller account will be shown to visitors of your Store and will also be used to refine products or Sellers by geolocation when Users conduct searches through our Service. You agree this data may be used to improve our Services, and that Google may collect and process this data according to Google’s terms and privacy policy.

Verify Your Business

Trust is the most important aspect in any transaction, potential customers simply won’t purchase anything unless they trust who they are purchasing from. This is why we require our Sellers to verify their business on our marketplace.

Verifying your business on our marketplace is a quick and easy process, and provides proof to your potential customers that you are indeed a reputable business with a valid address. To begin, you’ll need proof of your business address and business registration documents. You are also required to upload your Certificate of Insurance explicitly naming “Hemp Save The World Merchandising and its affiliates and assignees” as additional insureds on your Commercial General Liability policy.

Optionally, you may also upload a government issued photo ID (passport, ID card, or drivers license), your business phone number, and your business social media accounts.

  1. Create a Seller account through the Sell With Us page
  2. In the main navigation menu, under ‘Sellers’, go to ‘Seller Dashboard’ which is where you will manage your Store
  3. Click on ‘Settings’ and then ‘Verification’
  4. Upload three required documents: one confirming your business address, one confirming your business registration, and finally your Certificate of Insurance. Be sure to click ‘Submit’ for each document
  5. You may upload any other optional verification information on this page, or connect your social profiles
  6. We will review and either approve or disapprove your application

After we review and approve the required documents, we will enable your Store for selling and a Verification Badge will be added to your store.

The Verification Badge

Hemp Save The World employs a mandatory Seller verification process to maintain the integrity of our curated marketplace and protect other Sellers. Our process ensures every Store in our marketplace represents a legitimate manufacturer, wholesaler, retailer, or service provider within the industrial hemp industry.

Upon successful completion of our verification process, Sellers will be awarded the Hemp Save The World Verified Badge. This badge is a proprietary trust mark for all to see and is displayed beside the Seller’s Store name in their Store and in the Seller List. It serves as a guarantee to the customer that the Seller:

  • Has verified their identity and is a legally registered business entity.
  • Has provided other required documentation.
  • Maintains a high level of shipping reliability and customer responsiveness.
  • Ships their products directly or from an authorized fulfillment center.

Verification is an ongoing commitment to quality. Hemp Save The World reserves the right to temporarily or permanently remove the Verified Badge. To retain the Verified Badge, Sellers must be in good standing and adhere with our Terms of Service and Policies.

7. Wholesale Sellers

A Seller may become a Wholesale Seller. Hemp Save The World reserves the right to revoke wholesale privileges at any time if account activity or representation fails to comply with our Wholesale Policy. Please see our Wholesale Policy for more information about becoming a Wholesale Seller.

8. Seller Offerings

As an independent Seller on Hemp Save The World, you offer your items and services (“Seller Offerings”) for purchase by our Users’ based on your Store’s terms and conditions.

Our marketplace only allows industrial hemp-based products and services, and products containing industrial hemp derivatives. Industrial hemp is legally defined as cannabis plants and plant parts, of any variety, that contains 0.3% tetrahydrocannabinol (THC) or less in the leaves and flowering heads on a dry-weight basis, and also includes derivatives of industrial hemp plants and plant parts.

  • Listing Requirements: All listings of Seller Offerings must be accurate, truthful, and complete. You must provide clear and detailed descriptions, high-quality images, and accurate pricing.
  • Pricing: You are responsible for setting and maintaining your own prices and discounts. 
  • Shipping Policies: You must clearly outline your shipping policies, including shipping methods, costs, estimated delivery times, and any restrictions.
  • Return and Refund Policy: You are responsible for establishing and clearly communicating your own return, refund, and cancellation policies to Buyers. These policies must be fair and comply with applicable consumer protection laws. You must display your return policy prominently on your Seller profile and product pages.
  • Intellectual Property: You represent and warrant that you have the right to use all intellectual property, including trademarks, logos, and images, in your listings. You will not infringe on the intellectual property rights of others.

Prohibited Products and Services

You are strictly prohibited from listing any products or services that are illegal, dangerous, infringe on intellectual property rights, or violate this Seller Policy, our Terms of Service, or any of our policies. Some items and services are prohibited from our marketplace, even if they are legal in your area. 

We reserve the right to remove any Seller Offerings we deem inappropriate for our Services or violate any of our policies. We also reserve the right to suspend or terminate your account if you are found to violate our Terms of Service or any of our policies.

Controlled Substances, Alcohol, Smokables, Cannabis Flowers, THC, CBD, and other Cannabinoids

The offering, sale, or provision of services related to any controlled substance is strictly prohibited on Hemp Save The World. While some regions allow the sale of the following, we prohibit the offering, sale, or provision of items or services related to marijuana, alcohol, smokables, cannabis flowers, THC, CBD, drug paraphernalia, and other cannabinoids.

The legality of CBD product sales varies significantly by country, and often by state or region within those countries. In many places, the sale of CBD is illegal without a prescription, requires specific licensing, or is prohibited entirely, especially if it contains any detectable THC content. At this time, we prohibit the offering, sale, or provision of items or services related to CBD and other cannabinoids on Hemp Save The World due to restrictions set by our payment service provider (See Stripe’s Acceptable Use Policy).

Drug Paraphernalia

Drug paraphernalia are considered to be items intended to be used in the consumption or processing of narcotics, and includes, but is not limited to:

  • Grinders
  • Rolling papers
  • Joints, spliffs, & blunts
  • Roach clips
  • Pipes, pieces, & bowls
  • Bongs, bubblers, & hookahs
  • Oil rigs, domes, dabbers, and dab kits
  • Vaporizers & vape pens

We understand these may be legal to buy or sell in your area, nevertheless these items are considered to be drug paraphernalia and are prohibited from our marketplace, regardless of their legality.

Medical Drugs and Herbal Substances

Medical drug claims are statements or suggestions that an item prevents, remedies, cures, heals, or treats a medical condition or disease, and are subject to federal laws and regulations. Sellers are responsible to know and follow any law or regulation that is applicable to them and the items they sell. We strongly urge you to consult a qualified expert about the laws, regulations, and allowable disclaimers before making any medical claims about the items you sell. We cannot advise on this matter.

We prohibit all medical drugs and numerous herbal substances due to legality or potential harmfulness. We also prohibit some types of claims regardless of their accuracy, legality, or your belief in their truthfulness. Prohibited claims include, but are not limited to, claims that an item may:

  • Prevent, remedy, or cure a terminal or serious medical condition
  • Result in altering or transforming one’s body
  • Improve or enhance sexual performance; cure sexual dysfunction; or augment, enlarge, or enhance primary or secondary sexual characteristics

These prohibited claims always violate our policies, regardless of any disclaimers. We reserve the right to remove any items for which a Seller makes or implies any prohibited or false claims, and may terminate a Seller’s account if found to be in violation of this policy.

We may revise the list of claims we prohibit at any time. If you are unsure whether a claim you wish to make may be in violation of our policy, please reach out to us.

If a customer or another User provides a testimonial for your item, they must not make any prohibited claims and must comply with any applicable laws pertaining to endorsements or medical drug claims. Testimonials found to violate this policy will be removed.

Politically Divisive, Discriminatory, or Overtly Insensitive Items

We strive to cultivate an inclusive and respectful environment for all users on our platform. To maintain this standard, we strictly prohibit the listing or sale of any products, including their imagery, descriptions, or related content, that are deemed to be politically divisive, discriminatory, or overtly insensitive. This includes, but is not limited to, items that promote hate speech, incite violence, advocate for exclusion based on race, religion, gender, sexual orientation, or any protected characteristic, or exploit sensitive current events or tragedies for commercial gain. Our goal is to ensure a positive and welcoming experience for everyone, and products that create hostility or discomfort for any part of our community will not be permitted.

Endangered or Threatened Wildlife Products

According to the Center for Biological Diversity, scientists estimate species are going extinct up to 1,000 times the natural rate and they predict more than one million species could face extinction in the coming decade. Complex ecosystems, biodiversity, and symbiotic relationships maintain the delicate balance of life on Earth as we know it. We are losing about one species every hour, never to be seen again. This is most concerning as the loss of one species has a cascading ripple effect on nature, and losing key species will lead to catastrophic, irreversible consequences to the environment, our societies, and our economies.

Conservation of endangered species is vital for a sustainable future, this is why we prohibit the provision of items or services that threaten species identified to be at risk by the International Union for Conservation of Nature’s Red List of Threatened Species, CITES Appendix I, or any governmental body.

We may remove items or services that may be in violation of the law or this policy or if they are deemed to present risk to threatened species. Sellers are responsible to know and follow all applicable laws. We may terminate a Seller’s account if they are found to violate our Terms of Service or any of our policies.

Sanctioned Items and Services

It is prohibited to use our Services for any dealings, engagement, or sale of items/services linked directly or indirectly with jurisdictions Hemp Save The World has deemed to be high risk, including but not limited to Cuba, Iran, North Korea, Crimea Region, and Syria.

Hazardous and Dangerous Items

We prohibit certain hazardous and dangerous items from our marketplace for safety, legal and delivery reasons. Prohibited items include, but are not limited to:

  • Flammable substances
  • Toxic and poisonous substances
  • Explosives and their components and precursors
  • Government or manufacturer recalled items
  • Weapons and other items intended to be used to inflict harm

Food and Edible Items

Food and edible items are generally allowed on Hemp Save The World unless they violate our Terms of Service or any of our other policies. Sellers who wish to offer or sell food or edible items are responsible for complying with any and all government regulations in regard to the production, packaging, delivery, and sale of these items. We do not provide consultation on these matters, it is best to consult a lawyer as rules and regulations vary from place to place.

We also recommend consulting delivery carriers for specific restrictions regarding delivery of food and edible items.

Dietary and Food Supplements

Dietary and food supplements are generally allowed on Hemp Save The World unless they violate our Terms of Service or any of our other policies. Legal regulations around dietary and food supplements vary depending on the product, but may include testing and labeling requirements, ingredient restrictions, and medical drug claims. See our section on medical drugs and herbal substances for more information and what is prohibited on our marketplace. We urge you to consult a lawyer if you have questions about whether your items meet legal requirements.

9. Order Fulfillment

Sellers are responsible for fulfilling all orders placed by Buyers promptly and professionally. This includes packaging and shipping the products or providing the services as described in your listings. Sellers must ensure Buyers receive their orders, even if you utilize third-party delivery or fulfillment services.

By becoming a Seller and selling on Hemp Save The World, you agree to:

  • Provide an accurate “dispatched from” address
  • Charge an appropriate amount for postage
  • Identify postage costs and processing times on your Store and/or respective Seller Offering
  • Dispatch items promptly after they are sold. If you are unable to do so, you must inform your customer and email us without delay. If there is a significant delay, you must first obtain your customer’s consent before proceeding with the order
  • Comply with all local and international delivery and customs regulations
  • Dispatch respective sold items to the buyer’s shipping address
  • Update the status of every order depending on if the order has been completed, canceled, or refunded
  • Enter tracking information for each order that has been successfully processed

In the unlikely event an order does not arrive at the buyer’s shipping address, be prepared to provide valid proof of dispatch which shows the order was dispatched and was sent to the shipping address provided by the buyer.

Sellers may opt to purchase shipping insurance via their respective shipping service provider.

Free Shipping

While not required, it is recommended Sellers adjust their pricing strategy to allow for the provision of free shipping to their customers. By offering free shipping, Sellers may experience increased sales revenue, higher order values, and more customer satisfaction and loyalty.

The simplest way to offer free shipping is to include the average cost of shipping an item into the item’s price itself. Alternatively, another popular method of offering free shipping is to set a minimum order threshold, for example, free shipping on orders over $100.

10. Your Payouts

We use Stripe to process all payouts automatically. Your payout amount is calculated based on the fees outlined in this Seller Policy.

You are responsible for setting up your own Stripe account and connecting it to your Store on Hemp Save The World. In your Store settings, you will be directed to either connect your existing Stripe account or create a new Stripe account.

Payout Timing

  • First-time Sellers: New Stripe accounts typically experience a 7 to 14-business-day hold on their first payout. You can usually expedite this process by confirming your identity and establishing a history of positive selling activity. Learn more in Stripe’s Service Agreement.
  • Subsequent Payouts: After your initial payouts, you can expect to receive payments almost instantly in your Stripe account, though transfers to a bank account can take a few business days.

Stripe Climate (optional)

Stripe Climate is an innovative program that allows businesses like yours to contribute to fighting climate change directly through their Stripe account. By opting in, a small fraction of your revenue is automatically directed by Stripe towards cutting-edge technologies that permanently remove carbon dioxide from the atmosphere. This means that as you sell your hemp-based products or services and grow your business, you’re also making a tangible, ongoing contribution to environmental sustainability, helping to scale vital carbon removal solutions for a healthier planet.

11. Collection and Remission of Taxes

You are solely responsible for collecting and remitting any applicable sales taxes or other taxes related to your sales through our Marketplace.

Every country has its own national or subnational sales-tax system, and may have different names depending on the country, for example, HST, GST, PST, QST, RST, etc. We will help calculate and collect sales tax where applicable, but it is your responsibility to remit collected taxes to applicable authorities.

As a Seller on our Marketplace, understanding and fulfilling your sales tax obligations is crucial, regardless of where your business is based, and whether you’re selling domestically or across borders. In many jurisdictions in both countries, “marketplace facilitator” laws mean that our platform may be responsible for collecting and remitting sales tax (such as US state sales tax or Canadian GST/HST/PST) on your behalf for sales made through our site if we exceed thresholds in the applicable region(s).

However, your individual tax responsibilities extend beyond this. You are always responsible for your own income tax reporting to the relevant tax authorities (e.g., CRA in Canada, IRS in the USA). Furthermore, if you have sales channels outside of our marketplace (e.g., your own website), and if your sales volumes exceed specific economic nexus or registration thresholds in certain states or provinces, you may still be required to register, collect, and remit sales taxes independently. Due to the complexity and varying regulations in each country, especially for cross-border transactions, we strongly advise all our Sellers to consult with a qualified tax professional to ensure full compliance with all applicable tax laws in both their home country and the jurisdictions where their customers are located.

12. Our Customer Service Level Standards

Customer Service Expectations

We encourage you to provide your customers with a great experience every time they engage with your Store. Satisfied customers are more likely to leave positive reviews on your Store and the items they purchase, become repeat buyers, and promote your Seller Offerings within their personal networks – ultimately leading to more traffic to your Store and increased sales.

As a Seller on Hemp Save The World, you are expected to:

  • Communicate with Users in a respectful, professional mannerin accordance with our Community Policy.
  • Promptly respond to Buyers’ communications with respect, courtesy, and professionalism within a reasonable timeframe (e.g., within 24-48 hours).
  • Use our platform’s communication channels for all communication with Buyers, as to maintain transparency and provide a record of communication.
  • Provide guidance and resolutions for all Buyer inquiries, addressing issues and concerns related to your products or services, including returns, refunds, and order discrepancies, in accordance with your stated policies and applicable laws.
  • Upload accurate descriptions and images of your Store and Seller Offerings.
  • Fulfill your Seller Offerings in a timely manner once an order has been placed.
  • Use environmentally friendly packaging for all orders – biodegradable, compostable packaging materials. Make a reasonable effort to avoid the use of plastic.

You can avoid unfavorable reviews by managing Buyers’ expectations, working with them to resolve any issues that arise, proposing mutually agreeable resolutions, and assuring them preventative measures will be put in place to avoid similar situations in the future.

How Sellers’ Customer Service Performance Is Measured

Sellers’ customer service performance is assessed through multiple factors including, but not limited to accuracy of uploaded content, communication with other Users, and on-time Seller Offering fulfillment rate. We look for patterns that may lead to negative experiences for Buyers, such as lack of communication, unresolved inquiries, potentially unmanageable surges in order volume, or late shipping.

Failing to Meet Our Customer Service Level Standards

We understand some fulfilments won’t go as expected despite your best efforts. We will contact you if we determine your customer service is resulting – or likely to result – in negative experiences for Buyers. Our goal is to support the growth of our Sellers by providing education, guidance, and intervention if needed. 

Depending on the circumstance, and urgency of the situation, we may remove your Seller Offerings, temporarily pause your Store, delay outstanding payments, and/or suspend your account. If, after we contact you, you continue to fail to meet our customer services expectations, we may terminate your account indefinitely.

We provide multiple tools, features, and resources to help save you time, manage your Store, and provide excellent customer service. It is our hope these resources will lead to the success and growth of your Store. See a full list of benefits and features on our Sell With Us page.

  • Live Chat. Give quick, real-time support to registered users & customers through your Store.
  • Front-end Store Support. Provide a ticket-based support system right from your Store’s page.
  • Seller Offering Inquiry. Answer customer email inquiries originating from each of your Seller Offering’s pages.
  • Return and Warranty Requests. Offer customized return and warranty options to your customers.
  • ShipStation Integration. Import, manage, and ship your orders hassle-free with ShipStation’s easy-to-use dashboard. (ShipStation account required)
  • Staff Management. Create accounts and assign permissions for your staff to help manage your Store.
  • Estimated Delivery Dates. Set your own shipping policy in your Store settings.
  • Vacation Mode. Temporarily pause your Store if you need a break or need to catch up on orders.

13. Dispute Resolution

It is our aim to provide a respectful, professional environment for all of our Users. In the unfortunate event where Buyers are unsatisfied with a Seller or their Seller Offerings, you acknowledge the following:

  • Direct Resolution: You accept to attempt to resolve any disputes with Buyers directly first through the marketplace’s provided communication channels in a respectful, professional manner.
  • Hemp Save The World Assistance: If you are unable to resolve a dispute with a Buyer, either you or the Buyer may request assistance from Hemp Save The World’s customer support team.
  • Cooperation: You agree to cooperate fully with Hemp Save The World in the dispute resolution process and provide any necessary information or documentation.
  • Hemp Save The World’s Decision: You agree that Hemp Save The World may review disputes and make a final decision in certain circumstances, and further agree to abide by Hemp Save The World’s decision.

14. User Content

You’ll have the opportunity to customize your Store’s content to match your unique branding including your Store’s images, profile, terms of service, policies, and Seller Offerings. Your Store and all of your Seller Offerings must comply with our Terms of Service and our policies.

As outlined in our Terms of Service, “User Content” includes but is not limited to any usernames, Store names, text, images, photos, audio, videos, location data, ratings, reviews, comments, creative ideas, suggestions, proposals, plans, compilations, messages, or other information; whether online, by email, by postal mail, or otherwise; that is submitted to us or is publicly displayed by you on the Site or through our Services. We don’t make any claim to any User Content you submit to us, including anything you post using our Services.

By submitting User Content to any part of the Site, you represent and warrant that:

  • You are the sole author and owner of any intellectual property protected User Content you submit;
  • You are solely responsible for any contributions, comments, or postings you submit, including any feedback or questions;
  • When you submit User Content to affirm that all information in the content is truthful and accurate, and agree not to post any content that is false or misleading or uses our Services in a manner that is fraudulent or deceptive. We do not verify the accuracy of the information submitted by you;
  • You have not been offered, have not accepted, and are not entitled to receive any compensation in any form and from any party in connection with submitted User Content; and
  • You will indemnify, defend, and hold harmless Hemp Save The World and the Hemp Save The World Parties from any third-party claim(s) and any damages, losses, or injuries resulting from the display of your User Content.

You further agree and warrant that you will not:

  • Submit any User Content that is unlawful, offensive, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful, or is racially, ethnically, or otherwise objectionable or in violation of our Terms or any of our policies;
  • Submit any User Content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment;
  • Submit any User Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights or intellectual property of any party;
  • Submit any User Content that is false or misleading;
  • Invade another’s privacy in any way, including posting another’s personal details without their prior permission;
  • Manipulate identifiers in order to disguise the origin of any User Content submitted;
  • Intentionally or unintentionally violate any applicable local, state, provincial, territorial, national, or international law.

By submitting User Content to the Site or through our Services you hereby grant us a non-exclusive, royalty-free, irrevocable, worldwide, sub-licensable, perpetual license to use, display, publish, distribute, perform, store, reproduce, edit, modify, translate, and create derivative works of your User Content in any media or medium, form, format, forum, third-party website or service, or advertising platform, without compensation to you. This allows us to provide our Services, promote Hemp Save The World and our Services, and promote your Store and your Seller Offerings. Any unsolicited ideas or other materials you submit to Hemp Save The World (not including Seller Offerings you sell through our Services) are considered non-confidential and non-proprietary to you. You recognise our legitimate interest in using your User Content, in accordance with the scope of this license, to the extent your User Content contains any personal information.

You acknowledge that we have the right, but are not obligated, in our sole discretion, to refuse, move, edit, suspend, remove, or delete any User Content submitted, regardless of whether such content violates these Terms. 

We are, and shall be, under no obligation to (1) maintain any comments in confidence; (2) pay compensation for any comments; or (3) respond to any comments. We take no responsibility and assume no liability for any comments posted by you or any third-party. 

As stated before, it is a violation of these Terms to post or upload User Content you don’t own or have legal rights to. If your User Content is alleged to infringe another person’s intellectual property, we will notify you and either disable it if we receive proper notice or terminate your account if you are found to be a repeat infringer. We want to protect all our Users and their content. If you find your User Content has been posted or uploaded to our Services without your permission, and if you want it removed, please read Section 17 of our Terms of Service.

Search Engine Optimization

Search engines will recognize copied or duplicated content and penalize both sources of the duplicate content. Therefore it is strongly recommended Sellers upload unique descriptions of their Store and their Seller Offerings.

Image Requirements

We value a society which upholds honesty, trustworthiness, and overall strong moral principles. Trust is the most important aspect of a successful transaction and continued business into the future.

Sellers are responsible for ensuring uploaded images properly represent the item or service. Uploaded images of your Seller Offerings must be of the item or service itself, not a stock photo or rendering. By uploading images, you confirm that you are complying with our Terms of Service and have all necessary rights to use those images.

We understand some items or services cannot be photographed because they are personalised, made to order, or require design work. For these items and services, we ask that you upload images portraying examples of your similar previous work instead. This is to help manage your customers expectations, giving them the most accurate idea of what to expect. In addition, you must provide an accurate description detailing the item or service.

Mature Content

Hemp Save The World strives to maintain an enjoyable marketplace that is appropriate for general audiences, as such we have specific guidelines for mature content.

Mature content is classified into one of three generalized categories: sexually explicit, sexually suggestive, or graphic as defined below:

  • Graphic items are those with profane, degrading, violent, or gory imagery or text intended to shock, disgust, or encouraging others to commit violent acts
  • Sexually explicit items are those intended to be used during sexual activity, promote sexual wellness or enhance sexual pleasure, or depict or describe actual or simulated sexual acts including sexual intercourse, oral sex, or masturbation
  • Sexually suggestive items are those with imagery or text intended to be sexually indicative, evocative, or provocative

To ensure our marketplace is appropriate and enjoyable for general audiences, mature content must:

  • Be tagged with “mature content”
  • Use a primary thumbnail image that is appropriate for general audiences. Subsequent thumbnail images may reflect the totality of the item.

Pornographic content is strictly prohibited on Hemp Save The World.

15. Seller Staff

Through the ‘Staff’ menu in the Seller dashboard, you are able to create accounts for staff members for your Store. You are able to manage your staff’s individual permissions in a variety of ways including overviews, reports, orders, and coupons.

By adding staff to help manage your Store, to acknowledge and agree that you are responsible for the actions of your staff and the User Content uploaded through their associated accounts. Staff actions found to be in violation of our Terms of Service or any of our policies may lead to the suspension and/or termination of the staff account, or even your Store if issues are not remedied in a timely manner.

16. Fake Reviews

We take fake reviews very seriously as they are biased, inauthentic, or untruthful and can have serious consequences on all parties involved. Fake reviews are strictly prohibited from Hemp Save The World, and Users found to post fake reviews will be subject to their account being suspended or terminated and their reviews will be removed. The following are just some examples of fake reviews:

  • Businesses that directly or indirectly generate reviews for themselves
  • Businesses that pay for reviews or offer some sort of quid pro quo in exchange for reviews
  • Businesses that open or use other accounts to pose as and leave reviews as an independent User 
  • Employees who write positive reviews for their employers
  • Ex-employees who write retaliatory reviews of a former employer
  • Users who lie or exaggerate a bad experience to get a refund or some other compensation
  • Friends and family of a business who write biased, inauthentic, or untruthful positive or negative reviews on its behalf
  • Organizations that sell positive and negative reviews to businesses around the world

17. Extortion

Extortion is the practice of obtaining something through force or threats and is prohibited on Hemp Save The World. The following are some examples of extortion:

  • A user leaves a negative review of a Seller’s Store or Seller Offering in an attempt to force the Seller to provide compensation in exchange for the removal of the negative review
  • A user threatens to leave a negative review of a Seller Offering unless the Seller provides a refund, regardless of whether or not a refund is warranted

18. Termination

We reserve the right to suspend or terminate your Seller account at any time, with or without cause, including but not limited to:

  • Violation of this Seller Policy, our Terms of Service, or any of our other policies.
  • Engaging in fraudulent or illegal activities.
  • Consistently receiving negative feedback or complaints from Buyers.
  • Listing prohibited items.
  • Failure to comply with applicable laws and regulations.

Upon termination, your right to sell on our Services will cease, and any pending transactions may be cancelled. You will still be responsible for fulfilling any outstanding orders and addressing any issues from Buyers. We may withhold payouts for a reasonable period to ensure completion of transactions and resolution of disputes.

19. Limitation of Liability

You acknowledge that Hemp Save The World is a marketplace platform that facilitates transactions between Buyers and Sellers. We are not the buyer of your products or services.

To the fullest extent permitted by applicable law, Hemp Save The World disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, Hemp Save The World shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services as a Seller, even if we have been advised of the possibility of such damages. Our total liability to you for all claims arising out of or relating to this Seller Policy or your use of our Services shall not exceed the total amount of fees paid by you to Hemp Save The World in the one month preceding the event giving rise to the claim. 

20. Indemnification

You agree to indemnify and hold harmless Hemp Save The World, its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or relating to your use of our Services as a Seller, your products or services, your listings, your transactions with Buyers, your violation of this Seller Policy, or your infringement of any intellectual property or other rights of any third party.  

21. Governing Law and Jurisdiction

This Seller Policy, our Terms of Service, and our other policies shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Kelowna, British Columbia, Canada for the resolution of any disputes arising out of or relating to this Seller Policy, our Terms of Service, and our other policies.  

22. Changes to this Policy

Hemp Save The World reserves the right to modify or update this Seller Policy at any time without prior notice. Any changes will be effective immediately upon posting the revised Seller Policy on the Site. Your continued use of our Services as a Seller after the posting of any changes constitutes your acceptance of such changes. We encourage you to review this Seller Policy periodically for updates.
